Article 12: Governing law

These general terms of sale are governed by French law.

Article 13: Legal guarantees

13.1 Conformity

General terms of sale for consumer contracts must state in a box that, when acting under the legal guarantee of conformity, the consumer:

- has a period of two years from delivery of the goods to take action;
- may choose between repair or replacement of the goods, subject to the cost conditions set out in Article L. 211-9 of the Consumer Code;
- does not have to prove that the goods were non-conforming during the six months following delivery. This period is extended to twenty-four months from March 18, 2016, except for second-hand goods.

The same box reminds the consumer that the legal guarantee of conformity applies regardless of any commercial guarantee that may be given.
It also reminds the consumer that they may choose to invoke the guarantee against hidden defects in the goods sold, within the meaning of Article 1641 of the Civil Code, and that in that case they may choose between cancellation of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.

13.2 Hidden defects

Article 1641

The seller is bound by the guarantee for hidden defects in the thing sold that make it unfit for its intended use, or that so reduce that use that the buyer would not have bought it, or would have paid a lower price, had they known of them.

Article 1642

The seller is not liable for visible defects that the buyer could have discovered for themselves.

Article 1644

In the cases of Articles 1641 and 1643, the buyer may choose to return the thing and have the price refunded, or to keep the thing and have part of the price returned.

Article 1645

If the seller knew of the defects in the thing, they must, besides refunding the price they received, pay the buyer all damages.

Article 1646

If the seller did not know of the defects in the thing, they are bound only to refund the price and to reimburse the buyer for the costs of the sale.

Article 1647

If the defective thing has perished because of its poor quality, the loss falls on the seller, who must refund the price to the buyer and pay the other damages described in the two preceding articles. But a loss caused by an unforeseeable event falls on the buyer.

Article 1648

The buyer must bring an action for redhibitory defects within two years of discovering the defect.

Article 1649

It does not apply to sales made by court order.

The cost of returning goods is paid by the customer.
